Using A Patented Ingredient In My Product (?) (Supplement Question)

Hello,

Does anyone know how or if it's legal to use a patented ingredient in my own formula?

For example, NOW brand is using "CarnoSyn" branded Beta Alanine in their Beta Alanine product.
